AN ORDINANCE REPEALING

CHAPTER 15, ARTICLE 4 OF

THE CITY CODE RELATING

TO TOBACCO REGULATIONS

AND REPLACING IT WITH A

NEW CHAPTER REGULATING

THE POSSESSION, SALE, AND

CONSUMPTION OF TOBACCO

AND TOBACCO RELATED

DEVICES AND PRODUCTS WITHIN

THE CITY OF NEW BRIGHTON,

MINNESOTA

On June 11, 2019, the New

Brighton City Council adopted an

ordinance designated as Ordinance

No. 862, the title of which is stated

above. This summary of the

ordinance is published pursuant to

Minnesota Statutes Section 412.191,

subdivision 4. The ordinance repeals

the City’s tobacco regulations and

replaces them with new regulations.

The ordinance requires a license

to sell any licensed products within

the City. Licensed products include

tobacco, tobacco-related devices,

electronic delivery devices, and

nicotine or lobelia delivery products.

The license application requirements

are set forth in the ordinance. The

ordinance also sets forth the City’s

grounds for being able to deny a

license. Prohibited acts, including

the sale or giving away of licensed

products to persons under the age

of 21 are included in the ordinance.

The ordinance allows for tobacco

sampling in the City, but only

at tobacco and vapor products

shops. Smoking lounges, hookah

lounges, and vapor lounges are

prohibited. The ordinance provides

for compliance checks. Violations

and penalties are also set forth in

the ordinance. A printed copy of

the ordinance is available for public

inspection in the office of the City

Clerk during regular office hours.

This ordinance is effective upon

publication.
